Under MDR Annex VIII, most operating room furniture and equipment lands in Class I: non-sterile, non-measuring devices like standard operating tables, examination lights, and medical trolleys. Step 6 — Own Your Importer Obligations

This is where importers get hurt, because both systems make you a regulated actor, not just a customer. Under MDR Article 13, an EU importer must verify, before placing a device on the market, that it bears the CE mark, that the EU Declaration of Conformity exists, that the manufacturer and authorized representative are identified, that UDI and labeling requirements are met, and — where applicable — that a notified body certificate is valid. The importer’s own name and address must appear on the device, its packaging, or an accompanying document. If you suspect a device is non-conforming, you are obliged not to place it on the market and to inform the manufacturer and authorities. Storage and transport conditions are also your responsibility while the goods are in your custody.

On the US side, the foreign manufacturer’s US agent and the initial importer identified during device listing become part of FDA’s traceability chain. Common Pitfalls That Stall Shipments

Across the import projects we’ve supported, the same failure modes keep recurring. Avoid these and you’re ahead of most first-time importers:

  • Assuming one market’s clearance covers the other. A 510(k) number has zero legal standing in the EU; a CE mark has zero standing with FDA. Dual-market products need both files, deliberately maintained.
  • Buying the certificate instead of the configuration. The certificate applies to a defined device configuration. If the factory swaps motors, controllers, or suppliers between your sample and your production run, your certified configuration may no longer be what arrives.
  • Ignoring the authorized representative / US agent layer. A non-EU manufacturer without a named authorized representative, or a foreign establishment without a US agent, cannot lawfully complete the registration steps. Confirm these appointments in writing.
